  1. The ilarna Platform

2.1) ilarna provides an online platform for Approved Self-Employed Private Health Care Workers and Account Holders – Care Recipients – Care Guardians to connect with one another and to communicate and coordinate in the service of arranging in-home care service or care plan agreements, between one another: This is facilitated through providing connective services, which include an online database of Self-Employed Approved Private Carers – Caregivers.

Communication tools (including mobile applications) to facilitate interaction between Care Workers and Account Holders – Care Guardians and between Care Workers and fellow Care Workers when applied.

Payment systems (including Stripe, BACS, Credit Card, Debit Card, and Pre-Paid Cards) to enable transactions between Account Holder – Care Recipients – Care Guardian and Self-Employed Approved Carers – Caregivers.

Monitoring tools for Account Holders – Care Recipients to monitor care activity and review carers. Feedback tools (including those controlled by approved third parties) on care quality and Carer – Caregiver reviews. One Mobile App for both Carers- Caregivers and Account Holders – Care Guardians or clients to enable easier and more secure communications through the ilarna WebApp.

2.2) Platform provision ilarna is an introduction platform. ilarna provides an online marketplace to facilitate the process of finding in- home care and to provide a secure means for handling payments and secure communications. It also markets and introduces Carers/Caregivers to Account Holders – Care Guardians – Service Users. ilarna does not directly Supply Carers – Caregivers to Account Holders – Care Recipients – Care Guardians. For the avoidance of all doubt ilarna DOES NOT employ Care Workers – Caregivers – Carers.

ilarna does not act as an Employment Agency or Care Agency in any way. As such, ilarna is not permitted and will not make changes to a Care Recipient’s – Care Guardians Care Plan, provide scheduled rotas, or effect any control over the professional delivery of care. For the avoidance of doubt this is always the responsibility of the Account Holder – Care Guardian – Service User. We operate and provide the online tools to ‘self-manage your care needs’. ilarna is a Self- Management Care Model Platform.

2.3) For further avoidance of doubt ilarna does not: provide or arrange in-home domiciliary care services or participate in the interaction between Account Holders, except to make introductions and provide the tools and technology to facilitate the interaction, as well as managing the processing of payments through our payment partner on behalf of Care Recipients, Care Guardians or Service Users to Caregivers – Carers.

Neither does it involve itself in the terms of use between Carers – Caregivers and or Care Recipients – Care Guardians or the regulation of their engagement with each other except to ensure certain minimum rates of pay are maintained by account holders on the platform i.e., that all Carers – Caregivers on the platform charge at least the quality care fee of £15.00 GBP per hour. The Caregiver – Carer can personalise their hourly care fee in line with the care requested.

A Care Guardian – Care Recipient or Service User on the ilarna platform solely decides whether to accept an offer from a Carer – Caregiver to provide the in-home domiciliary care services. The Care Guardian – Service User – Account Holder solely decides whether to engage a Carer – Caregiver to provide in-home domiciliary care services. The service agreement – Care Plan created by the Carer – Caregiver at the start of an assignment and accepted by the Care guardian – Care Recipient is a legal contract between each of these parties. Any subsequent associated shifts and costs are from the Carer – Caregiver to the account holder and their creation by the Caregiver – Carer is merely facilitated by the platform software.

2.4) Platform constraints

The ilarna platform is used at the Account Holder’s – Care Recipient’s – Care Guardian and self-employed approved Carer’s – Caregivers own risk and there is no guarantee that the platform will work optimally, not be subject to downtime, or removed from service at any point in time. ilarna does not accept any liability for losses or damages caused by the unavailability of the service, technical errors, usage errors, network errors or use of the platform outside of the intended purpose. ilarna disclaims any liability for controversies, losses, injury, accidents, claims, or damages arising out of the use of the online tools it provides, the engagement of Carers – Caregivers or the provision of care services by Carers.

2.5) Communications

You agree that our app, e-mail, SMS video calls and internal communication tools will be the official means of communication within the ilarna platform. We may occasionally use other messaging services or further internal messaging to account holders via the platform. As a business we take the welfare of all users of the platform as our number one priority. As such we reserve the right to monitor all communications transmitted via the ilarna platform. To maintain high levels of Carer – Caregiver response times ilarna may from time to time make use of a ‘mystery service user’ to gauge Carer – Caregiver response times and general quality levels of client interaction. We also monitor all messaging on the site both manually and by using artificial intelligence. By agreeing to these terms & conditions you explicitly agree to a ilarna ‘mystery service user’ having the right to contact you on an ad hoc basis and the right of ilarna to have oversight over all messaging on the platform for security, data, and performance reasons.

  1. The platform

3.1) Vetting and background checking of Carers – Caregivers

ilarna makes every reasonable effort to check the identity and information provided by Carers – Caregivers. This includes visual and online biometric checks of passports – Identity cards – driving licenses to confirm identity and right to live and work in the UK, including stated qualifications and training certificates where available, DBS (PVG Scotland) (NI Access N. Ireland) checking.

Although ilarna carries out these checks and arranges a pre-qualified verification video call interview to every Carer – Caregiver who applies and qualifies on the platform, ilarna is not responsible for, nor has it control over the quality, timing, legality, reliability, responsibility, integrity, or suitability of the self-employed carers listed on the platform. ilarna strenuously recommends that the Account Holder – Care Recipient – Care Guardian carry out their own assessment of a Carer’s – Caregivers suitability before engaging into a Service Agreement – Care Plan with them by interviewing Carers – Caregivers (ideally in person). And in particular: By verifying in person, a Carers – Caregivers identity via photographic ID. By requesting proof of experience, training, qualifications, authorisations, and suitability for the position they are applying for. By following up on references (at ilarna or the Carer’s – Caregivers discretion) of Carers – Caregivers by telephone or email with their referees.

3.2) Insurance cover

Carers – Caregivers working through the ilarna platform are covered by our group self-employed Carer’s Insurance. Policy details of which are available from the ilarna head office or e-mail hello@carecite.com We recommend that Account Holders – Care Recipients – Care Guardians should check if their own home insurance also covers Carers – Care Givers working in their home for added security.

For the avoidance of doubt any transaction between an “Account Holder” and a “Care Worker” that occurs off platform is not covered by this self-employed Carers – Caregivers insurance policy and is also likely to result in the removal of both the Account Holder and the Carer from the platform with immediate effect.

3.3) Account Holder – Care Recipient – Care Guardian – Carer – Caregiver code of conduct.

You must not discriminate against a health Care Worker, Caregiver – Carer, or a Client, Care Recipient Account holder or Care Guardian based on colour, nationality, disability, sex, or any other potential source of discrimination. In addition, you represent and warrant that you if you are a Carer – Caregiver or you and every member of your household if you are a Client – Care Recipient – Care Guardian have never been the subject of a complaint, restraining order or any other legal action involved with being arrested for, charged with, or convicted of any criminal offence that involves endangering the safety of others, through either dishonesty or negligence, and are not nor have ever been on the sex offenders register or other similar list.

This rate is agreed between you and the Care Worker. If the care has been delivered, then it must be paid for. Our automated system ensures payments are processed on delivery of care.

  1. Legal Contract

5.1) Once you have accepted the Service Agreement – Care Plan set up by the Service User – Care Guardian, you are bound by the terms of that agreement. Subsequently your initial acceptance to the planned service agreement with your Carer you will receive either a one-off or regular shift via the platform. ilarna can offer no mediation or intervention regarding perceived non-compliance with the Service Agreement except return of funds for noncompleted but paid for shifts.

If for any reason a shift is only partially completed within the care plan then it is the responsibility of the Carer -Caregiver to cancel, reissue or edit a new shift that reflects the hours or days worked or fulfil the shortfall of the shift at no extra cost to the care recipient.

  1. User conduct and disputes

6.1) Any agreements are legally binding agreements between the Account Holder – Care Recipient – Care Guardian and the Carer, Caregiver. ilarna are not party to any agreement, and we cannot arbitrate or mediate if there is an alleged breach of contract. Ilarna does not accept any liability for claims, demands or direct or indirect damages arising from disputes between Account Holders – Care Recipient – Care Guardians and Carers – Caregivers.
